This Privacy Policy, including any amendments thereto (hereinafter referred to as the ‘Policy’), is issued by Jaipur Villa Works (OPC) Pvt Ltd, a private limited ‘one person company, having CIN No. U46411MH2023OPC405796, and PAN No AAGCJ0665B* and having an office at Thakur Village, Kandivali (E), Mumbai 400101 (hereinafter referred to as ‘we’, ‘our’, ‘us’, or the ‘Company’).

To the extent permissible under the Applicable Laws, this Policy is issued with and is governed by the Terms of Use (hereinafter referred to as the ‘Terms’) of the website (www.jaipurvilla.in) and the mobile application titled (Jaipur Villa) (hereinafter referred to as the ‘Platforms’) which is owned and operated by the Company.

This Policy governs the Processing (defined below) of your Data (defined below), and further shall:

1. Provide information on the types of Data Processed, the duration, purpose, storage, retention, and disclosure thereof; and

2. Establish your rights, duties and obligations pertaining to such Processing.

By accessing the Platforms and/or using any Service, you hereby agree to be bound by the terms of this Policy. If you do not wish to have your Data Processed by us, kindly refrain or cease (as the case may be) your access to the Platforms and/or use of any Services.

   1. You hereby understand and agree that access to the Platforms and/or use of any Services is strictly prohibited to any Invalid User. In the event, we discover that any Invalid User’s Data has been Processed, the same shall be purged immediately, subject to the Applicable Laws and the terms of this Policy.

   1. Data you provide us: We request from you the following Data at the corresponding stages of accessing the Platforms and/or using the Services:

      1. For creating a User account: If you opt to create a User account on the Platforms and, we collect the following Data:

         3. Mobile number;

         4. Address, and;

         5. Demographic data, which includes your age group, gender;

 

1. Placing an order: When you place an Order on the Platforms, either as a ‘Guest’ or with a User account, we collect the following Data:

   3. Mobile number (Billing and Shipping, if separate);

   4. Address (Billing and Shipping, if separate);

 

1. We do not Process any financial Data you enter on the Platforms for any purpose. Such information is collected by a third-party payment processor and shall be subject to such third parties’ terms and conditions.

      1. Your Data is stored on (Wix.com), with servers located in Europe & the USA in accordance with the following protective measures and controls.

      2. We have undertaken all reasonable efforts to safeguard your Data in consonance with such standard of protective measures as prescribed under the Applicable Law. However, you agree that no safety measure is fool proof and 100% secure and therefore:

         1. We shall not be responsible for any breach of security in respect of events outside our reasonable control, including but not limited to, unauthorized computer attacks, system crashes, and similar events, collectively classified as force majeure events.

         2. In the event of a Data breach as a result of a force majeure event, you hereby waive any claim against us, and our Related Parties for any losses and/or damages arising out of such breach.

         3. We shall not be responsible for any breach of security owing to your actions on the Platforms.

         4. We shall not be liable for any loss of Data and/or damage to you as a consequence of your negligence with respect to your User account’s login credentials, or any other such information that is confidential in nature.

      3. In the unlikely event we discover or are made aware of a Data breach, we shall notify you as soon as practicable.

   1. We shall not retain your Personal Data longer than required, subject to the provisions and any requirements under the Applicable Laws.  

   2. However, we shall reserve the right to retain any anonymized, non-Personal Data for our internal audit, performance review, backup, archiving, and any other such purpose that we deem necessary.

 

1. RIGHTS OVER YOUR DATA:

As under the Applicable Laws, you shall be entitled to exercise the following rights with respect to your Data:

 

1. Right to withhold or withdraw consent:

   1. Prior to, or during Processing of your Data, you shall be entitled to withhold, or withdraw (as the case may be) your consent for the same.

   3. You agree and accept that we shall not be made liable for a Claim or be made a party to any legal proceeding arising out of the deletion of any of your Data in furtherance of this clause.

   4. Kindly note that withholding or withdrawal of consent may result in us restricting or terminating your access to the Platforms and/or use of any Services thereon.

   1. You shall reserve the right to review any Data you provide and ensure that any Personal Data if found to be inaccurate or deficient, be corrected or amended as feasible.

   1. We shall, from time to time, communicate Platform Content, service announcements, and other information which may or may not be in the nature of promotional content.

   2. By consenting to the Processing of your Data under this Policy, you hereby permit us to communicate such Platform Content as described under this sub-clause, provided however, you shall reserve the right to unsubscribe from receiving such Platform Content.

      3. You have voluntarily set preferences provided for on your Device and/or the Platforms and shall undertake all reasonable efforts to inform any changes in the same, either through the mechanisms thereon and/or contact information provided below.

      4. You shall update and correct, as and when required, your Data and not hold us, and/or our Related Parties liable for any Claim as a consequence of any inaccuracy or error in your Data.
